PTC Assist, LLC (“PTC Assist”), a Kansas Limited Liability Corporation, is a consumer reporting agency regulated by the Fair Credit Reporting Act, 15 U.S.C. §1681 et seq. (“FCRA”) and other federal and state laws.

This Privacy Policy covers how PTC Assist collects, uses, protects, and shares information collected from users of PTC Assist websites, applications, software, email newsletters, subscriptions, social media, or any of PTC Assist’s digital properties (the “Services”). By using the Services, you expressly consent to PTC Assist’s collection, use, disclosure, and retention of your information as described in this Privacy Policy.

Information Collection

PTC Assist uses the information it collects for the purpose of providing the Services. Information provided to us will not be shared with any other organization, agency, corporation, entity, or third-party except as stated in this policy or the Terms of Use without the express written consent of those users. PTC Assist may collect certain information about you when you use the Services. The information collected may vary, and may include the following categories of information:

  • Personal information, such as your name, social security number, social insurance number, national identification number, other county or state identification number, passport information, current employment information, driver’s license information, professional license information, education, date of birth, email address, mailing address, and phone number;

  • Account information, such as your username or password (or anything else that identifies you) used to access or use the Services, including, without limitation, to create an account;

  • Any and all other information that you choose to provide to PTC when you interact with or use the Services.

  • Information collected through automated methods, such as, without limitation, cookies, beacons (“pixels”), or Flash cookies, which identify an individual computer’s browser or other information about a website user. Cookies are small files that assist in providing customized services.  We use information collected through automated methods to help analyze web page flow and to measure promotional effectiveness. We offer certain features that are only available through the use of a cookie.

  • We may also collect information about your visit to the Services, which may include the number of visitors, which pages are frequently visited, user domain names, and browser types.

Use of Personal Information

PTC Assist collects personal data for the purposes of communicating with our members and others who request that we communicate with them (e.g. through signing up for the Services or requesting information from us) and providing our clients with information required to make employment screening decisions. All data is collected, stored, and delivered in compliance with applicable laws, including the FCRA and other local, state, and federal laws. PTC Assist may also use the information we collect from you for various purposes, including in one or more of the following ways: to establish an account, to handle customer service and support, to provide access to our Services, and to comply with applicable law and comply with PTC Assist’s legal obligations. PTC Assist may also transfer your information to third parties for processing in order to provide our clients with the services requested. We require such third parties to keep the information confidential.

Personal Information Disclosure: United States or Overseas

PTC Assist does not send consumer information outside of the United States or its territories for any purpose other than to deliver a report to an end user. If information is sought from outside of the United States, the information is gathered in that country and then transmitted to us here in the United States where it is treated as any other consumer information.

Information Sharing & Disclosure

Except as otherwise provided in this Privacy Policy, as required by law, or pursuant to your consent, we do not transfer to outside parties your personal information. We sometimes retain the services of third parties to perform functions on our behalf, including data aggregation, hosting, data analysis, and responding to specific requests.

We may disclose personal information to third parties in order to perform services requested or functions initiated by you and for functions and purposes relating to the Services. For example, if you have submitted personal information to PTC Assist at the request of a PTC Assist client for purposes of procuring a background report of you, we may disclose your information to such PTC Assist client as part of their requested background screening investigation of you.

In addition, we may disclose personal information in order to identify you in connection with communications sent through the Services. In some situations, your information will be shared with a third party that you have a specific relationship with, such as, for example, your employer.

PTC Assist may share information, including personal information, to enforce our rights, enforce our site policies, protect our property, or protect the rights, property, or safety of others, or as needed to support external auditing, compliance, and corporate governance functions. We will disclose personal information as we deem necessary to respond to a subpoena, regulation, binding agency order, legal process, governmental request, or other legal or regulatory process. We may also share personal information as required to pursue available remedies or limit damages we may sustain.

PTC Assist may disclose your information for legal or administrative purposes to maintain, service, and improve our products and services, as allowed by law.

Information about our customers, including personal information, may be disclosed as part of, or during negotiations of, any merger, transfer, sale, acquisition, or other change of ownership or control by or of us or any affiliated company (in each case whether in whole or in part).

We may provide aggregate data and information to third parties to describe how our customers are using the Services.

PTC Assist does not sell personal information to anyone and has not done so in the past 12 months.

Security

PTC Assist has put into place reasonable security measures, including appropriate technical, contractual, administrative, and physical measures in an effort to protect personal information from loss, misuse, or alteration while it is under our control. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while we strive to protect your professional information, PTC Assist cannot guarantee or ensure the security of any information you transmit to us or from our site. PTC Assist may change or enhance the security protection without notice to you. You shall not attempt to disable or circumvent any security feature on the PTC websites.

To the greatest extent allowed by law, we are not responsible for any security incident involving your data, including because of the unauthorized actions of our employees, service providers, or unaffiliated persons. You are responsible for maintaining the security of any password, user ID, or other form of authentication involved in obtaining access to password-protected or secure areas of the Services. In order to protect you and your data, we may suspend your use of any of the Services, without notice, pending an investigation, if any breach of security is suspected. Access to and use of password-protected or secure areas of the Services are restricted to authorized users only. Unauthorized access to such areas is prohibited and may lead to criminal prosecution.

Third-Party Links

When using the Services, you may sometimes be linked to external websites or services. PTC Assist is not responsible for any website or service not operated by PTC Assist. A link to any Third-Party website or service does not mean that we endorse it or the quality or accuracy of information presented on it.  If you decide to visit a Third-Party website or service, you are subject to its privacy policy and practices and not this Privacy Policy.

Information Relating to Children

The PTC websites are not intended for children. PTC does not knowingly collect information from individuals under the age of 18.

Accessing or Correcting Your Information

If you are a PTC Assist client with a registered account, your User ID only allows you to view materials related to your relationship with PTC Assist, and provides no ability to view materials for any other party. You shall not attempt to access or view materials for any other party. If, for any reason through your use of the Services, you access or acquire any materials not related to you or your relationship with PTC Assist, you shall immediately inform PTC Assist at info@pipelinetesting.com and refrain from accessing or downloading such materials. You may review (and update) your account information by logging into your account.

If you are an individual for whom a PTC Assist client has requested a background screening investigation, and have submitted personal information to PTC Assist at the request of such client for purposes of procuring a background report, then you can review your PTC Assist file in accordance with your file disclosure rights under the Fair Credit Reporting Act, California Civil Code Section 1786.22, and any other applicable state laws by contacting the PTC History Check Department at admin@ptcassist.com

“Do Not Track” signals

At this time, there is no consistent industry standard concerning what websites should do in response to “Do Not Track” signals.  Thus, we do not currently take any action in response.

California Residents

The California Consumer Privacy Act (“CCPA”) does not apply to PTC Assist because PTC Assist is not a “Business” pursuant to California Civil Code Section 1798.140(c).

Colorado Residents

The Colorado Privacy Act does not apply to PTC Assist pursuant to Colorado S.B. 21-190 § 6-1-1304.

Connecticut Residents

The Connecticut Data Privacy Act does not apply to PTC Assist pursuant to P.A. 22-15 § 2(1)-(2); Id. at § 1(7).

Nevada Residents

Nevada residents may send a request to opt out of the sale of personal information to the address under the “Contact” section, below or by calling this toll-free number: 800-294-8758. PTC Assist may ask you to verify your identity after receiving such a request.

Utah Residents

The Utah Consumer Privacy Act (“UCPA”) does not apply to PTC Assist pursuant to Utah S.B. 227 § 13-61-102(1).

Virginia Residents

The Virginia Consumer Data Protection Act (“VCDPA”) does not apply to PTC Assist pursuant to Va. Code Ann. § 59.1-576 (Effective January 1, 2023).

Terms and Conditions

All users of the Services are subject to PTC Assist’s “Terms of Use” establishing the terms and conditions of your use of the Services as well as disclaimers, mandatory arbitration, class waiver, and limitations of liability governing the use of the Services. The Terms of Use is incorporated into this Privacy Policy.

Your Consent

By using our site, you consent to this Privacy Policy and PTC Assist’s Terms of Use.

Notice of Changes to Privacy Policy

This Privacy Policy may be modified or amended at any time without prior notice. Upon request, we will provide you with a written copy of this Privacy Policy. We encourage you to review this Privacy Policy each time you access the Services to be informed of how PTC Assist is protecting your information.

PTC Assist will notify consumers of material changes to its Privacy Policy by posting an updated privacy policy on its website.
